TERMS & CONDITIONS
Only South African citizens who are resident in the Republic of South Africa are eligible for entry.
Competition entrants must be at least 18 years of age as at the date of entry or their participation in the competition confirmed in writing by their legal guardian.
Competition entrants shall at the date of entry hold a valid passport, which passport shall be valid for travel to the United States of America (“U.S.”) and which validity date shall be at least 6 (six) months beyond the competition travel date.
In the event that the U.S. embassy or consular deny the prize winner a visa for any reason whatsoever, or upon awarding the prize it is the judge’s opinion (in the exercise of the judge’s sole discretion) that the prize winner is not in fact the right candidate to represent the Hurley brand or the prize winner has been dishonest in any manner whatsoever, the prize winner will forfeit his or her prize and Hurley South Africa reserves the right to select at its discretion another prize winner.
A competition entrant’s surfing skill and age and the quantity of merchandise visible in the photograph are of no significance in determining the prize winner and the judge's decisions will be final and no correspondence will be entered into. The judge will be entitled to use his/her discretion in relation to the award of the prizes. The prize winner shall indemnify and hold Hurley South Africa harmless against any loss, damage or injury to the prize winner arising in the course of any of the activities relating to the competition or the prize.
Competition entrants enter into the competition at their own risk and Hurley South Africa will not be responsible for any loss, damage, injury or harm suffered as a result of participation or as a result of the award or use of any prize.
Prize winners will be notified via email, cell phone or telephone once prizes have been awarded. If Hurley South Africa is unable to contact any prize winner, having made reasonable efforts to do so, the prize awarded to that prize-winner will be forfeited.
Prizes are not transferable and may not be converted into cash.
Staff members of Hurley South Africa, members of their family, agents of or consultants to Hurley (or any other person or company who holds, conducts, promotes, organizes or is any other way directly associated with the management or execution of the competition); or a spouse, life partner, parent, child, brother, sister, business partner or associate of such a person – may not participate in the competition.
If any prize is not claimed within 2 months of the prize winner concerned being announced, such winner forfeits the prize.
It is a pre-requisite to the award of any prize that the prize winner’s entitlement will be as determined by the judge and the prize winner will be responsible for any additional costs relevant to the prize (including medical or travel insurance, if applicable) and the prize winner will be obliged to attend the award function and to allow photographs to be taken of the prize winner and published by Hurley South Africa.
Competition entrants hereby consent to their photographs and blog uploaded onto the Hurley South Africa website, being used by Hurley South Africa to promote and market the Hurley brand.
Save for clause REF _Ref257187714 \r \h 13 above, Hurley South Africa shall refrain from disclosing the competition entrants’ personal information (including cell phone number and email address), unless the competition entrants indicate in the blocks provided on the Hurley South Africa website that they consent to their personal information being disclosed and used by Hurley South Africa.
Hurley South Africa shall be entitled, in its discretion, to cancel and / or suspend the competition.
- are not afflicted with a communicable disease of a public health significance;
- are not determined to have a physical or mental disorder and behaviour associated with the disorder that may pose, or has posed, a threat to the property, safety, or welf
- are of the competition entrant or others or have had such a disorder and associated behaviour which behaviour is likely to recur or lead to other harmful behaviour;
- are not drug abusers or addicts;
- have not been convicted or have admitted to a crime involving moral turpitude (or an attempt or conspiracy to commit such a crime);
- have not been convicted or have admitted to a crime involving a violation (or conspiracy or attempt to violate) of any law or regulation relating to a controlled substance;
- have not been convicted to 2 (two) or more offences and been sentenced to confinement for a period of 5 (five) years or more;
- are not controlled substance traffickers;
- are not prostitutes or procurers of prostitutes or competition entrants going to the U.S. to engage in any other unlawful commercialised vice;
- are not persons involved in the trafficking of persons;
- are not engaged in money laundering;
- are not engaged in any terrorist activities or party to or member of any terrorist organization or political, social or other group that endorses or espouses terrorist activities;
- are not involved in any unlawful activity of whatever nature; and
- have not previously been removed from the U.S. within a period of 5 (five) years.
The competition entrant indemnifies and holds Hurley South Africa free and harmless from any and all claims, losses, damages, injuries and liabilities arising from and in connection with the use of the Hurley South Africa website or in connection with any information, pictures, photographs or any of like.
Hurley South Africa reserves the right to delete at its sole discretion any competition entrant’s profile in the event that in Hurley Africa’s opinion they are found to be involved in any unfair and/or unlawful action in respect of their use of the Hurley South Africa website and all services associated therewith.
